1. Acceptance of Terms

By downloading, installing, or using YapBrain (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

YapBrain is an AI-powered note-taking application that allows you to capture thoughts via voice recordings, which are then transcribed and organized using artificial intelligence. The App provides features including voice-to-text transcription, AI-generated summaries, task extraction, and note organization.

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. User Content

You retain ownership of all content you create within the App ("User Content"), including voice recordings, notes, and any other materials.

By using the App, you grant us a limited license to process your User Content solely for the purpose of providing the App's features, including AI transcription and organization services.

You agree not to submit content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights of others
• Contains harmful, abusive, or offensive material
• Contains malware or malicious code

5. Subscriptions & Payments

Some features of the App may require a paid subscription. If you choose to subscribe:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

6. AI Features Disclaimer

The AI features in YapBrain, including transcription and content organization, are provided "as is." While we strive for accuracy, AI-generated content may contain errors. You should review and verify all AI-generated transcriptions and suggestions. We are not responsible for decisions made based on AI-generated content.

7. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use automated systems to access the App without permission
• Resell or redistribute the App or its features
• Use the App to record conversations without proper consent

8. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by YapBrain Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAPBRAIN INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
